Taking the Bar Exam to Become a Patent Attorney or a Patent Agent

There could be two different reasons why an individual would be planning to take the patent bar exam. One of these reasons would be that you are planning to become a patent attorney, and the other reason would be if you are planning to become a patent agent. Individuals who have plans to take this exam generally are planning a practice to prosecute with the United States Patent and Trademark Office or USPTO.

Generally any individual that has become a patent attorney, has already passed their state bar exam. They have also normally finished law school as well. To become a patent agents you are required to pass the patent bar exam, but it is not necessary for you to have passed the state bar exam. One advantage that could be beneficial to those who plan on becoming a patent agent is that you do not have to have a law degree to do so. Those who have finished college and the appropriate undergraduate courses can take the exam that is required to become an agent.

When it comes time for you to begin your search for legal work in the field of patent prosecution, it can be very helpful for you to have already taken the patent bar exam. It can be very helpful in finding employment in patent law if you take the exam before taking the necessary courses in law school.

Some individuals may not be aware of this fact, but there is actually not very much difference at all between a patent attorney and that of a patent agent. This of course applies when it comes to work in the patent prosecution area.

To qualify for the bar exam you must meet one of two requirements that show that you have had some type of technical background in your course of studies. You either should have taken a sufficient amount of credit hours in the hard science courses, or you must have a degree awarded from an accredited university in either the study of hard science or the study of engineering. In qualifying for the exam under these conditions, it is required for you to show evidence of having taken these courses by sending your school transcripts along with your application to take the bar exam.

After submitting your transcript and application to the United States Patent and Trademark Office, the process taken to approve applicants can take as long as two to three weeks before you will receive any type of notification that you have been approved.

An ID number will accompany the approval notice that you will receive from the USPTO. You will need this ID number to be able to register at one of the Prometric testing centers, for a convenient date and time to take the exam.

You are also given the option of either registering and scheduling a time for the exam on the Internet or you can simply register for the exam by telephone. At most of the testing centers, the exam is generally given five days a week. You can phone a testing center near you, to verify the times it is given in your area.

You will be given ninety days to schedule a date and time to take the exam, after the date that your application has been approved.
